1. Agreement to Terms

By accessing or using Backbone AI ("Backbone," "we," "us," or "our") at usebackbone.online, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Services

Backbone provides an AI-powered business automation platform for service businesses, including but not limited to: AI phone receptionist services, automated SMS and email follow-up, appointment scheduling, social media content creation and publishing, lead management, and related automation services. Services are provided on a subscription basis according to the tier selected at signup.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or your business. By using Backbone, you represent that you meet these requirements.

4. Subscriptions and Payment

Backbone is offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis at the rate for your selected tier. All fees are non-refundable except as required by law.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We reserve the right to modify pricing with 30 days notice.

Payment processing is handled by Stripe. By subscribing, you also agree to Stripe's terms of service.

5. Your Responsibilities

You are responsible for:

• Providing accurate business information during onboarding and keeping it current
• Ensuring you have the right to connect any social media accounts or third-party services to Backbone
• Complying with all applicable laws, including telemarketing laws (TCPA), CAN-SPAM, and platform terms of service when using our automated messaging features
• Ensuring your customers have consented to receive automated SMS and email communications where required by law
• Maintaining the confidentiality of your account credentials

6. Acceptable Use

You may not use Backbone to:

• Send spam, unsolicited messages, or harassing communications
• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the platform for any purpose other than legitimate business automation

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for any losses resulting from service interruptions.

8. Intellectual Property

Backbone and its content, features, and functionality are owned by Backbone AI and are protected by intellectual property laws. You retain ownership of your business data and content. By using Backbone, you grant us a limited license to process your data solely to provide our services.

9. Limitation of Liability

To the maximum extent permitted by law, Backbone shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue, arising from your use of our services. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Disclaimer of Warranties

Backbone is provided "as is" without warranties of any kind, express or implied. We do not warrant that our services will meet your specific requirements or that results from using our services (such as lead generation or appointment booking rates) will meet any particular standard.

11. Termination

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate your account immediately for violations of these Terms. Upon termination, your access to the platform will cease and your data will be retained for 90 days before deletion.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of Backbone after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.
